Memory Care Rules in Nebraska

Nebraska's term is "Alzheimer's Special Care Unit"; it isn't a separate license, but rules apply to facilities that offer dementia care. Facilities must give families a written disclosure of their dementia care services.

  • An Alzheimer's special care unit is any licensed nursing facility or assisted-living facility which secures, segregates, or provides a special program or special unit for residents with a diagnosis of probable Alzheimer's disease, dementia, or a related disorder and which advertises, markets, or otherwise promotes the facility as providing specialized Alzheimer's disease, dementia, or related disorder care services (Neb. Rev. Stat. 71-516.03).
  • The facility must disclose, to the department and to any person seeking placement in the unit, the form of care or treatment that distinguishes it as especially applicable to or suitable for such persons; the department examines the disclosures at licensure or relicensure (Neb. Rev. Stat. 71-516.04(1)).
  • The disclosure must explain the unit's philosophy and mission, placement, transfer and discharge criteria, assessment and care planning, staff training and continuing education, physical environment and design features, frequency and types of resident activities, family involvement and support programs, and the costs of care and any additional fees (Neb. Rev. Stat. 71-516.04(2)).
  • Staff training and continuing education practices shall include, but not be limited to, four hours annually for direct care staff (Neb. Rev. Stat. 71-516.04(2)(d)).
  • Statute provides for a memory care endorsement on an assisted-living facility license, with qualifications to include staffing enhancements, staff training, dedicated memory care programming, cultural competencies, facility requirements, and security issues (Neb. Rev. Stat. 71-422.01 and 71-472).
  • An assisted-living facility which is an Alzheimer's special care unit may apply for a memory care endorsement but shall not advertise itself as an endorsed memory care unit without such endorsement (Neb. Rev. Stat. 71-517).
